GENERAL CONDITIONS

CLAIM:The paperwork processed with the Airline on behalf of the Client, i.e. the air passenger, as a result of a denied boarding, cancellation or delay of a flight.

CLIENT:The person who instructs SkyCompass or the air passenger who holds a Claim against the Airline.

AIRLINE:The airline that operated the delayed or cancelled flight or was scheduled to operate the flight.

AGREEMENT:The Agreement between the Client and SkyCompass on the basis of which the Client will authorise SkyCompass to collect the Claimwhich is entered into when submitting the Claim to completion on the SkyCompass website.

EXTRAJUDICAL PROCESS:The composing and sending of letters (of default) as SkyCompass sees fit or the collection of the Claim in any other way, including (settlement) negotiations with the Airline and reaching an amicable settlement with the Airline;

JIDICAL PROCESS:The legal proceedings initiated for the Claim by and/or on behalf of SkyCompass, on their own account or that of the Client, including (but not limited to) the composing of a legal summons and/or the initiation of legal proceedings against the Airline, (settlement) negotiations with the Airline and reaching an amicable settlement with the Airline.

SkyCompass reserves the right, at any time and without prior notice, to remove or cease to supply any product or service contained on this website. In the event that such removal takes place we shall not be liable to you in any way whatsoever for such removal.

In order to determine your claims, we collect, manage and process data, including scheduled flight progress, actual flight progress, flight weather and other data relating to air traffic.

We assert your claim for Flight Compensation from the operating airline in accordance with EU regulation 261/2004 or any other Air Passenger Rights Regulation applicable to your travel(s).

By entering into an agreement with us, you warrant that you are authorized and have the legal capacity to enter into the agreement.

You also warrant that the claim has not been assigned to third parties and no legal dispute is pending or expected between you and the airline in the same matter.

You shall provide us with all data or information that is required for the execution of this agreement, on request by us. You warrant that the data and information provided is correct, complete and true. In case of incorrect data/information and fraudulent conduct, we reserve the right to terminate the agreement with immediate effect. You will not have any right to compensation of any kind if the agreement is terminated according to this paragraph.

To successfully pursue the claim, SkyCompass requires the Assignment Form or the Compensation Request Agreement signed by the client, which the client can send to SkyCompass through the web form, mobile application, email, or postal service. Upon receiving a signed Assignment Form or a Compensation Request Agreement from the client, SkyCompass prepares a payment request and sends it to the airline that operated the flight without undue delays and manages all subsequent correspondence.

SkyCompass operates on a ‘no win – no fee’ basis.
In the case of success, the fee taken for the compensation claim by SkyCompass will be displayed on the website: this is usually 17% without VAT of the expenditure compensation under Art. 7 of Regulation (EC) no. 261/2004

After entering into an Agreement, SkyCompass can refuse to pursue a Client’s Claim without any reason, but will notify the Client of its refusal within a reasonable time period.The Client is not allowed in any case to terminate the Agreement unilaterally, unless under the statutory provision that entitles the Client in his/her capacity as a consumer to withdraw from the Agreement within a 14-day term from the conclusion date of the Agreement without giving any reasons.Non-timely performance of the agreement by SkyCompass does not give the Client and/or Claimant(s) the right to compensation or to suspend any obligation towards SkyCompass.

By checking the box “I give my consent to SkyCompass to process the claim on my behalf” when submitting the request via the website www.skycompass.eu, the client accepts and agrees with these general conditions. The client is bound by them and must comply with them.
